Washington and Nevada Consumer Health Data Privacy Policy.

The Net Project (“Net Project,” “we,” “our,” and/or “us”) values the privacy of individuals who use our website and related services (collectively, our “Services”). This Washington and Nevada Consumer Health Data Privacy Policy (the “Privacy Policy”) applies to those living in Washington or Nevada or whose Consumer Health Data is collected in either of those states, as well as individuals whose information we collect in Washington or Nevada  as a small business under Washington’s My Health My Data Act (“Users,” and/or “You”) or as a regulated entity under Nevada’s Health Privacy Act (SB 370). This Consumer Health Data Privacy Policy explains how we collect, use, and share Consumer Health Data from you and how you may exercise certain privacy rights. Beyond this policy, your use of our Services is also subject to our Terms of Service and our Privacy Policy.

Who is The Net Project?

The Net Project is a platform designed to help you develop healthier perspectives on the meaning of life and to reframe the ways you think about meaning and wellbeing. Our Services are interactive, and our services give you the opportunity to respond to topics and questions about your life experiences. These questions may cover topics such as your experiences with: self acceptance; personal growth; managing life situations; wellness; relationships with others, establishing a sense of purpose; among other topics.

Depending on how you respond to these questions, the information we receive may include data that is considered Consumer Health Data under U.S. privacy laws. For the purposes of this notice, Consumer Health Data means personal information that is linked or reasonably linkable to a consumer and that identifies the consumer’s past, present, or future physical or mental health status, or as otherwise defined by Washington’s My Health My Data Act (“MHMDA”) and/or the Nevada Health Privacy Act.

Consumer Health Data does not include information that is:

  • Publicly available information. 

  • Deidentified data.

  • Otherwise excluded from the scope of the MHMDA or Nevada Health Privacy Act.

We collect Consumer Health Data from the following categories of source(s): directly from you.


Purposes for Collection and Use of Consumer Health Information 

We collect and use Consumer Health Data to provide you with the products or Services you have requested, for other purposes permitted under MHMDA and/or Nevada Health Privacy Act. We process your Consumer Health Data using methods such as automated processing and manual human review, depending on the nature of the Consumer Health Data and the purposes of collection, use, and disclosure. These uses may include: 

  • Providing, maintaining, improving, and enhancing our products and services to you;

  • Personalizing our services and products tailored for your wellness needs;

  • Understanding how you use our services to develop new features or services to support our mission and improve our service to you;

  • Communicating with you, sending you text messages providing you with updates and other information relating to our services, providing information that you request, and otherwise providing customer support;  

  • Marketing and advertising purposes, such as developing and providing promotional and advertising materials that may be relevant, valuable or otherwise of interest to you;

  • Facilitating the connection of third-party services, such as matching you with a Provider; 

  • Finding and preventing fraud and abuse, and responding to trust and safety issues that may arise; 

  • For compliance purposes, including enforcing our Terms of Use or other legal rights, or as may be required by applicable laws and regulations or requested by any judicial process or governmental agency;  

  • Anonymizing and aggregating information for analytics and reporting;

  • Administering wellness questionnaires;

  • Facilitating transactions and payments.

Third Parties With Whom We Share Consumer Health Data 

To the extent necessary to provide you with the products or Services you have requested or for other purposes permitted under MHMDA and/or Nevada Health Privacy Act, we share Consumer Health Data with the following categories of third parties (excluding those who constitute “processors” who only process consumer health data on our behalf for limited purposes pursuant to our instructions):  

  • Government agencies.  We may share your information if we believe doing so is required or appropriate to: (a) comply with law enforcement requests and legal process, such as a court order or subpoena; (b) respond to your requests; or (c) protect your, our, or others’ rights, property, or safety. The sharing of your information may occur if you post any objectionable content on or through the Services.

We may allow a third party to collect your Consumer Health Data over time and across different Internet websites or online services when you use our Services.  

Consumer Rights 

If you are a Washington or Nevada resident or an individual whose information is otherwise covered by MHMDA and/or Nevada Health Privacy Act, you may exercise the following rights, subject to certain exceptions: 

  • The right to confirm whether we have collected, shared, or sold Consumer Health Data concerning you. 

  • The right to access Consumer Health Data concerning you that we have collected, shared, or sold, including a list of all third parties and affiliates with whom we have shared or sold the data and an active email address or other online mechanism that you may use to contact these third parties (we do not sell your Consumer Health Data).

  • The right to withdraw consent from our collection and sharing of consumer health data concerning you.  

  • The right to request deletion of the Consumer Health Data concerning you.

  • The right to request that we cease collecting, sharing, or selling such data. 

  • The right to appeal any decision with regard to your privacy request.
